Virginia Auto Insurance Requirements

Virginia is a "Tort" state, which means drivers are financially responsible for all property damage and bodily injury they cause in an accident. Most Virginians choose to purchase an auto insurance policy as proof of their financial responsibility.

If you choose not to purchase auto insurance, you can pay $500 to the Department of Motor Vehicles (DMV) to drive your car uninsured.

A standard auto insurance policy consists of several parts:

  • Liability insurance will help to cover the costs on both property damage and bodily injury that are a result of an accident for which you are at fault. The auto liability minimums are 25/50/20 (see the chart below).

Drivers may also purchase uninsured/underinsured motorist coverage, which helps pay for damages (property damage and bodily injury) in the event that you are in an accident with a driver who does not have enough insurance or no insurance at all.

Many Virginia drivers choose to protect themselves even more by carrying optional collision, comprehensive, medical expense, loss of income, and/or funeral expense coverage.

Coverage Type Required? Minimum Coverage Amount Required
Bodily Injury Liability Yes

$25,000 per person

$50,000 per accident

Property Damage Liability Yes

$20,000

Uninsured/Underinsured Motorist Bodily Injury No

$25,000 per person

$50,000 per accident

Uninsured/Underinsured Motorist Property Damage No

$20,000

You may want to consider purchasing limits of coverage higher than those required by law to protect your assets or property, as you may be personally responsible for any damages above the policy limits.
